Due Care

The summons of driving without due care and attention, or without reasonable consideration for other road users is a complicated summons to answer. The Crown must prove that the defendant has departed from the standard of care of the ordinary, competent and prudent motorist, i.e. the Crown must prove that you are at fault.  At the highest end this can attract either nine penalty points or an indeterminate period of disqualification.
