Drink Driving Penalties
Under Section 4 of the 1988 Road Traffic Act and Section 1 of
the 1991 Road Traffic Act: it is an offence to use or be in charge
of a mechanically propelled vehicle on a road or public place
whilst under the influence of drink or drugs.
Drink driving penalties can vary
depending on circumstance. You may be disqualified from driving for
at least 12 months, the fine you receive from the court could be up
to £5000, or in some circumstances your licence may be endorsed
with penalty points.

Here are some examples of drink driving offences and
the penalties and fines which may be imposed upon
you.
Drink driving or attempting to drive with
excess of alcohol
- Obligatory disqualification
- Maximum Prison sentence: 6 months
- Maximum Fine: £5,000
In charge with excess alcohol
- Penalty points: 10 or a discretionary disqualification
- Maximum Prison sentence: 3 months
- Maximum Fine: £2,500
Failing to co operate with a preliminary test
- Discretionary disqualification
- Maximum Fine: £1,000
- Penalty points: 4
Failing or refusing to supply an evidential specimen when
driving or attempting to drive
- Obligatory disqualification
- Maximum Prison sentence: 6 months
- Maximum Fine: £5,000
Failure to allow specimen to be subject to laboratory
tests when driving or attempting to drive
- Obligatory disqualification
- Maximum Prison sentence: 6 months
- Maximum Fine: £5,000
Causing death by dangerous driving under the influence of
alcohol
- Obligatory disqualification
- Maximum Prison sentence: 14 years
- Fine: Unlimited
