The Police can offer a fixed penalty of 6 penalty points and a
£200 fine. If the matter proceeds by summons the Court will
consider imposing 6-8 penalty points for first offences. However,
it can also order a disqualification up to 12 months for the most
serious offences.
A financial penalty will always be imposed, with the amount
dependent on a defendant's means and the circumstances of offence,
but the maximum fine can be £5000. It will be regarded as a matter
of fact, i.e. whether there was insurance in place or not.
The driver has the responsibility to ensure that the policy is
valid and in order before using the vehicle. It is also an offence
for permitting a vehicle to be used by an uninsured driver,
punishable by 6-8 penalty points and a fine. Whether using or
permitting someone to use your vehicle without insurance, there are
defences and special reasons available in certain
circumstances.
