Terms Of Business
Subject to the terms and conditions as set out below, you will
be entitled to specialist legal advice and assistance from Freeman
Keep On Driving Ltd, whether by telephone, or through the Freeman
Keep On Driving Ltd website in respect to any issues relating to
motoring offences.
The following conditions will apply:-
1 Unless stated otherwise, the following terms shall
mean:-
Advice - any legal advice provided by the Advisers relating to
any motoring issue or offence
The Agreement - the agreement acknowledged and accepted by the
Participant subject to these terms and conditions
Retention Fee - the cost of retaining the services of Freeman Keep
on Driving Ltd as set out in The Agreement
Participant - the person or persons named on The Agreement
Reference Number - the unique seven digit number allocated to each
Participant

2 Scope of the Agreement
2.1 For the duration of The Agreement, the Participant shall be
entitled to Advice and access to the Website which shall be
available and accessible to the Participant 24 hours a day 7 days a
week (including public holidays).
2.2 Prior to any Advice being given or the Participant obtaining
access to the Website the Participant must produce their Reference
Number. In the event the Reference Number is mislaid or
stolen, the Participant must immediately notify the Service
Provider who will give the Participant a new Reference Number for
future use.
2.3 Any legal representation which may be required by any
Participant anywhere in England and Wales shall be paid for
independently of the Retention Fee but shall be arranged by the
Service Provider (wherever possible) at an agreed fixed fee.
2.4 The Service Provider reserves the right to cancel the
Participant's retention of the services of the Service Provider in
the event that the Participant has in any way acted dishonestly,
fraudulently, committed any breach of the terms or has permitted
the use of the service by an unauthorised person. In such
circumstances the Participant shall not be entitled to any refund
of the Retention Fee.
2.5 The Service Provider reserves the right to withdraw from The
Agreement at any time. In the event of any withdrawal the Service
Provider shall refund to the Participant the Retention Fee on a pro
rata basis but shall not otherwise be liable for any other claim
howsoever arising. In such circumstances the Service Provider
shall provide the Participant with no less than 30 days' notice of
the withdrawal from The Agreement.
2.6 To the extent as permitted under statute or regulation
relevant to the operation of The Agreement the Service Provider
strictly excludes the Service Provider's liability (whatsoever or
howsoever arising) to the Participant under The Agreement and in
the event of the Service Provider being liable in any respect under
The Agreement such liability shall be limited to the total monies
paid by the Participant in respect of those particular
proceedings.
3 Retention Fees
3.1 Retention of the services of the Service Provider is for a
period of twelve months from the date of the acknowledgement and
acceptance of The Agreement and payment in full of the Retention
Fee. Retention of the services of the Service Provider is renewed
automatically unless the Service Provider is advised otherwise by
the Participant.
3.2 The Retention Fee shall be payable on the acknowledgement
and acceptance of The Agreement, or payable immediately by way of
debit or credit card.
3.3 In the event of default of payment, the Service Provider
reserves the right to terminate the Participant's retention of
services with immediate effect.
4 Miscellaneous
4.1 Any personal data obtained by the Service Provider pursuant
to The Agreement shall be dealt with in accordance with the Data
Protection Act 1998 and any statutory modifications or Regulations
relating thereto.
4.2 In accordance with the terms of The Agreement the
Participant shall be entitled to opt in to allow the data held by
the Service Provider to be passed to third parties.
4.3 If any term, clause or provision of these terms and
conditions shall be adjudged to be invalid for any reason
whatsoever by a court of competent jurisdiction, such invalidity
shall not affect the validity or operation of any other term,
clause or provision. Such invalid term, clause or provision
shall be deemed to have been deleted from these terms and
conditions, so as to give the remaining term, clause or provision
effect.
4.4 This Scheme shall be operated in accordance with English law
and shall be subject to the jurisdiction of the English courts.
