Subject to the terms and conditions as set out below you will, as a Member, of the Keep On Driving Membership Scheme be entitled to specialist legal advice and assistance, whether by telephone, or through the Keep On Driving website in respect to any issues relating to motoring offences.
The following conditions will apply:-
1 Unless stated otherwise, the following terms shall mean:-

2 The Scheme
2.1 For the duration of the Membership Agreement, the Participant shall be entitled to Advice
from the Appointed Advisers and access to the Website which shall be available and
accessible to the Participant 24 hours a day 7 days a week (including public holidays).
2.2 Prior to any Advice being given by the Appointed Advisers or the Participant obtaining
access to the Website the Participant must produce his Pin Number. In the event the Pin Number is mislaid or stolen, the Participant must immediately notify the Service Provider who will give the Participant a new Pin Number for future use.
2.3 Any legal representation which may be required by any Participant anywhere in England
and Wales shall be paid for independently of the Membership Fee but shall be arranged by the Service Provider (wherever possible) at a reduced hourly charge rate.
2.4 The Service Provider reserves the right to cancel the Participant’s membership of the
Scheme in the event that the Participant has in any way acted dishonestly, fraudulently,
committed any breach of the terms of the Scheme or has permitted the use of the
Scheme by an unauthorised person. In such circumstances the Participant shall not be
entitled to any refund of the Membership Fee.
2.5 In the event of any withdrawal or suspension the Service Provider shall refund to the
Participant the Membership Fee on a pro rata basis but shall not otherwise be liable for
any other claim howsoever arising. In such circumstances the Service Provider shall
provide the Participant with no less than 30 days’ notice of the withdrawal or suspension
of the Scheme.
2.6 The Service Provider shall not be responsible for any advice or legal representation
provided under the scheme which shall be the responsibility of the Appointed Advisers or
the legal representatives appointed to represent the Participant in whatever capacity.
2.7 To the extent as permitted under statute or regulation relevant to the operation of the
Scheme the Service Provider strictly excludes the Service Provider’s liability (whatsoever
or howsoever arising) to the Participant under the Scheme and in the event of the Service
Provider being liable in any respect under the Scheme such liability shall be limited to the
value of the annual Membership Fee.
3 Membership Fees
3.1 The Membership Fee as set out in the Membership Agreement shall entitle the Participant to membership of the Scheme for a period of twelve months from the date of the Membership Agreement. Membership is renewed automatically unless the Service Provider is advised otherwise by the Participant.
3.2 The Membership Fee shall be payable on the signing of the Membership Agreement, or payable immediately by way of debit or credit card.
3.3 In the event of default of payment, the Service Provider reserves the right to terminate the Participant’s membership of the Scheme with immediate effect.
4 Miscellaneous
4.1 Any personal data obtained by the Service Provider pursuant to the Scheme shall be dealt with in accordance with the Data Protection Act 1998 and any statutory
modifications or Regulations relating thereto.
4.2 In accordance with the terms of the Membership Agreement the Participant shall be
entitled to opt in to allow the data held by the Service Provider to be passed to third
parties.
4.3 If any term, clause or provision of these terms and conditions shall be adjudged to be
invalid for any reason whatsoever by a court of competent jurisdiction, such invalidity
shall not affect the validity or operation of any other term, clause or provision. Such
invalid term, clause or provision shall be deemed to have been deleted from these terms
and conditions, so as to give the remaining term, clause or provision effect.
This Scheme shall be operated in accordance with English law and shall be subject to the jurisdiction of the English courts.
